Terms & Conditions

1. DEFINITIONS

Platform: means the Nexa Nurse mobile application, website, APIs, and related services.

Client: means any individual booking services through the Platform.

Escrow: means temporary holding of funds pending service completion.

2. ACCEPTANCE OF TERMS

By accessing or using the Platform, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, you must immediately stop using the Platform.

3. ROLE OF NEXA NURSE

Nexa Nurse operates solely as a technology marketplace that connects Clients with independent Service Providers.

• We do not provide medical or healthcare services.
• We do not employ Service Providers.
• We do not supervise or control how Services are performed.
• We do not guarantee outcomes, quality of care, or suitability.

All Services are provided independently by Service Providers exercising their own professional judgment.

4. ELIGIBILITY

Users must:

• Be at least 18 years old
• Have legal capacity to contract
• Provide accurate and complete information

5. ACCOUNT SECURITY

Users are responsible for maintaining the confidentiality of their login credentials. You are responsible for all activity on your account. Nexa Nurse is not liable for losses resulting from user negligence or unauthorized access.

6. BOOKINGS, PAYMENTS & ESCROW

• All bookings and payments must occur within the Platform.
• Payments may be held in escrow until service completion or confirmation.
• Nexa Nurse may delay or withhold payments where fraud, disputes, or policy violations are suspected.

Refunds, cancellations, and disputes are handled in accordance with Platform rules in effect at the time.

7. NO MEDICAL ADVICE / EMERGENCIES

The Platform does not provide medical advice or emergency services. In case of a medical emergency, Clients must contact local emergency services immediately. Nexa Nurse is not responsible for emergency response, medical decisions, or treatment outcomes.

8. CONSUMER PROTECTION

Nexa Nurse complies with applicable consumer protection laws. Nothing in these Terms limits rights that cannot legally be excluded.

9. TERMINATION & ENFORCEMENT

Nexa Nurse reserves the right to suspend or terminate accounts, cancel bookings, or remove content to protect users, comply with law, or prevent abuse or fraud.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Nexa Nurse is not liable for acts, omissions, or conduct of Service Providers, nor for medical outcomes, injuries, or indirect damages arising from Services.

11. INDEMNITY

Users agree to indemnify and hold harmless Nexa Nurse from claims, losses, or legal fees arising from the use of the Platform or breach of these Terms.

12. DISPUTE RESOLUTION

Users agree to attempt informal resolution first. If unresolved, disputes shall be resolved by binding arbitration in Nigeria and governed by Nigerian law.

13. GOVERNING LAW

These Terms are governed by the laws of the Federal Republic of Nigeria.

14. CHANGES TO TERMS

Nexa Nurse may update these Terms at any time. Continued use of the Platform constitutes acceptance of the revised Terms.
